Seller Terms & Conditions

These Seller Terms and Conditions (the "Agreement") govern the usage and activities of vendors ("Seller" or "You") on the Maribali.com.bn online marketplace platform ("Platform"). By registering as a Seller and accessing or using the Platform, you acknowledge and agree to comply with these terms and conditions. Please read this Agreement carefully before proceeding.

Seller Registration and Account:

  1. Eligibility: Seller must be at least 18 years old and have the legal capacity to enter into binding contracts.
  2. Registration: To become a Seller, you must complete the registration process, providing accurate and up-to-date information. Vendor is responsible for maintaining the confidentiality of your account credentials and are liable for any activities conducted through your account.
  3. Account Suspension: Maribali.com.bn reserves the right to suspend or terminate your Seller account in case of any violation of this Agreement or applicable laws.

Seller Obligations and Conduct:

  1. Prohibited Products: Seller shall not list or sell any products or services that are illegal, infringe upon intellectual property rights, or violate any laws or regulations of Brunei.
  2. Product Listing: Seller is responsible for accurately describing the products, including prices, quantities, specifications, and any applicable terms and conditions.
  3. Compliance with Laws: Seller shall comply with all applicable laws, regulations, and industry standards in relation to your activities on the Platform, including tax obligations, licensing requirements, and consumer protection laws.
  4. Prohibited Activities: Seller must not engage in any fraudulent, deceptive, or unethical practices, including but not limited to spamming, manipulating reviews or ratings, or engaging in unfair competition.
  5. Intellectual Property: Seller represents and warrants that you have the necessary rights and permissions to use any trademarks, logos, images, or other intellectual property rights associated with your products or store.
  6. Data Privacy: Seller shall handle buyer data in compliance with applicable data protection and privacy laws and only use such data for the purpose of fulfilling orders and providing buyer support.
  7. Buyer Communication: Seller is responsible for promptly responding to buyer inquiries, providing accurate information, and resolving any issues or disputes in a professional manner.

Fees and Payments:

  1. Transaction Fees: Maribali.com.bn does not charge transaction fees for sales made through the Platform.
  2. Payment Processing: Payments from buyers will be processed by the payment gateway integrated with the Platform. The funds, minus any applicable fees, will directly be transferred from buyer to vendor designated bank account according to the agreed-upon payment schedule.
  3. Shipping fees: Seller is responsible for paying the shipping fees directly to Maribali Delivery. Timely payment of delivery fees to Maribali Delivery is expected from vendors. It is important to note that Maribali.com.bn will not be responsible for additional costs in the case of failed delivery. Sellers should ensure the accuracy of shipping information and coordinate with Maribali Delivery to avoid any complications that may result in extra charges.

Refund, Return and Exchange Policies:

  1. Maribali.com.bn is a platform that facilitates transactions between seller and buyer. When buyers make purchases on Maribali, the payments are processed directly to the seller. Maribali does not hold or manage any funds on behalf of sellers.
  2. It is crucial to establish and clearly communicate seller own refund, return, and exchange policies to the buyers. This ensures transparency and sets expectations for buyers. Make sure to provide detailed information about eligibility, timelines, and any additional requirements that you have in place.

Termination:

  1. Termination by Seller: Seller may terminate this Agreement by providing written notice to Maribali.com.bn. However, any outstanding obligations, such as fulfilling pending orders, must be completed before termination.
  2. Termination by Maribali.com.bn: Maribali.com.bn reserves the right to terminate this Agreement or suspend Seller account at any time for violations of this Agreement, fraudulent activities, or non-compliance with applicable laws and regulations.

Limitation of Liability:

  1. Maribali.com.bn shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with vendor use of the Platform or any transactions conducted through it.
  2. Seller agrees to indemnify and hold Maribali.com.bn harmless from any claims, losses, damages, costs, or liabilities arising out of your breach of this Agreement, violation of laws, or infringement of third-party rights.

Governing Law and Dispute Resolution:

This Agreement shall be governed by and construed in accordance with the laws of Brunei Darussalam. Any disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Brunei Darussalam.

Amendments:

Maribali.com.bn reserves the right to modify or amend these Seller Terms and Conditions at any time. Any changes will be communicated to you through the Platform or via email. Your continued use of the Platform after the effective date of any amendments constitutes your acceptance of the modified terms.

By registering as a Seller on Maribali.com.bn, you acknowledge that you have read, understood, and agreed to be bound by these Seller Terms and Conditions.
